The Terms and Conditions described here apply to every product offered on www.brooklyn.be and all deliveries. Every order implies acceptance of the sales conditions. Only Belgian Law applies to the Terms and Conditions of Brooklyn.
| The consumer has the right to inform the seller that they renounce the purchase, without payment of a penalty and without giving a reason within 14 calendar days from the day following the delivery of the product or the conclusion of the service agreement. |
Purchase and Payment
- The agreement between Brooklyn and you as the buyer is established at the moment you have accepted and complied with the conditions set by Brooklyn. The absence of a regular signature does not affect the binding nature of the offer and its acceptance.
- Brooklyn reserves the right to refuse an order or to subject it to additional conditions, such as for large orders, orders by minors, incomplete order procedures, or issues with previous orders.
- Brooklyn always confirms the purchase by email. If no confirmation email has been sent, the agreement is not yet in effect.
- Payment for products purchased at Brooklyn is made exclusively through the proposed online payment methods.
- The seller remains the owner of all goods until full payment has been made.
- To ensure secure online payment and the safety of your personal data, transaction details are encrypted with SSL technology over the internet. You do not need special software to pay with SSL.
- In case of late payment, Brooklyn is entitled to dissolve the agreement with immediate effect or suspend (further) delivery until you have fully met the payment obligations.
- The Terms and Conditions and confirmation emails are always drawn up in the language of the website.
Delivery and Delivery Times
- The delivery times provided by Brooklyn are approximate and are not strict deadlines. The maximum delivery period is 30 days after receipt of the order.
- If a product that is temporarily out of stock is ordered by you, it will be indicated when the product will be available again.
- Once the products to be delivered have been delivered to the specified delivery address, the risk for these products transfers to the buyer.
- For deliveries abroad, different conditions may apply.
- Brooklyn delivers to the following countries: Belgium, Netherlands, France, Germany.
- Delivery is made exclusively by Courier service unless otherwise agreed prior to the agreement. You can find the contact details of the Courier service on the following website: www.bPost.be.
- The delivery or shipping costs will be communicated to you before confirming your purchase. If the shipping costs cannot be calculated automatically, this will be mentioned and/or an indication of the shipping costs will be provided.
Product Information
- Information, images, oral communications, statements, etc. regarding all offers and the main characteristics of the products provided by phone or email are given or made as accurately as possible. Brooklyn is not liable for advice provided, printing and typographical errors on the website, or technical data provided by suppliers or producers.
- The availability is indicated for each product. Brooklyn does everything possible to communicate this information correctly. However, it may occur that delivery is impossible due to unintentional incorrect stock data or products that are no longer available from suppliers. In these cases, Brooklyn will notify you as soon as possible and offer you a solution.
- The products offered by Brooklyn comply with legal standards and may be sold online.
- It is possible that Brooklyn includes links on its website to other websites that may be interesting or informative for the visitor. Such links are purely informative. Brooklyn is not responsible for the content of the website referred to or its use.
Cooling-off Period and Returns
- For all products purchased at Brooklyn, you have a cooling-off period of 14 calendar days according to Belgian law concerning commercial practices, consumer information, and consumer protection of April 12, 2010.
This period starts at the moment of receipt by you or on your behalf. During the cooling-off period, we expect you to handle the goods and packaging with care. There is no right of withdrawal if the product and packaging are no longer in their original, complete, undamaged, and unused state. - If you wish to exercise the right of withdrawal, you must notify us in writing or by phone within the specified 14 calendar days from the day following the delivery of the product. Renouncing the purchase does not involve payment of a penalty and can be done without giving reasons. The withdrawal form can be downloaded here. More information about canceling or returning your order can be found in the section cancel, return, and exchange on our website.
- You must return the goods undamaged, unused, and unopened (in original condition and packaging and with the original brand labels as applied by the manufacturer) no later than 14 calendar days after receipt. The shipping date serves as control. All accompanying documentation, warranty certificates, and packaging materials must be included with the return shipment, as well as your bank account number. The return costs are free only if the buyer uses the provided return label and only if you return from Belgium. If the buyer chooses to return in another way (or if you send from outside Belgium), these costs are borne by the buyer. Unstamped or insufficiently stamped shipments are always refused and returned to the sender.
- Brooklyn will refund you the full purchase amount (excluding shipping costs with your own shipping method) within 30 days of receiving the goods.
If it appears that the goods have not been received in accordance with the conditions of the right of withdrawal, the purchase amount and shipping costs will not be refunded, or not fully refunded. In that case, the product remains your property. At your request, the product can also be sent back to you, provided you pay the associated shipping costs. - Exceptions to the stated provisions are the following:
- If a product has been specially made or altered for you, you logically have no right of withdrawal.
- This exception also applies to perishable goods, CDs, DVDs, software, CD-ROMs, or other similar products whose seal has been broken or whose packaging has been opened.
- If a product has been visibly worn or otherwise damaged, your right to a refund of your payment expires.
- Goods must be returned to the following address:
Brooklyn nv, Industriezone
Politieke Gevangenenstraat 34
8530 Stasegem - Harelbeke
Belgium
Warranty Provisions
- Brooklyn follows the official warranty guidelines of its suppliers. These vary by brand and will always be specified when you purchase your item.
- Handling of warranty will be covered by Brooklyn except for the shipping costs incurred by the consumer to return the product to us.
Defects
- You are required to inspect the goods carefully immediately upon receipt. You should check whether the delivered goods comply with the agreement:
- Were the correct goods delivered?
- Do the delivered goods meet the agreed quality requirements or, if these are missing, the requirements that may be expected for normal use?
- If a visible defect or shortcoming is found, you must report it to Brooklyn within 7 working days of delivery.
- A non-visible defect must be reported by the consumer in writing via email to Brooklyn within 2 working days of discovery.
- The costs for returning goods that do not meet the description of the offer are borne by Brooklyn.
Force Majeure
- Force majeure is understood to mean all external causes, foreseen or unforeseen, over which Brooklyn has no control, but which prevent Brooklyn from fulfilling its obligations.
- Brooklyn is also entitled to invoke force majeure if the circumstance preventing (further) fulfillment occurs after Brooklyn should have fulfilled its obligation.
- During force majeure, Brooklyn's delivery and other obligations are suspended. If the period during which fulfillment of obligations by Brooklyn is not possible due to force majeure lasts longer than 8 weeks, both parties are entitled to dissolve the agreement without any obligation to pay compensation.
Prices
- The prices of the goods will be communicated to you before checkout. All prices are expressed in Euros and include VAT, Recupel, BEBAT, and Reprobel. Shipping costs are listed separately.
- If Brooklyn agrees on a certain price with you, Brooklyn is nevertheless entitled to increase the price.
- Offers are valid while stocks last.
- If a price increase occurs after the agreement is concluded, you can dissolve the agreement regardless of the percentage of the increase.
Intellectual Property Rights
- The content of this site, including brands, logos, drawings, data, product or company names, texts, images, etc., is protected by intellectual property rights and belongs to Brooklyn or entitled third parties.
Questions and Complaints
- Just like for our offline customers, Brooklyn wants our online customers to fully enjoy their purchase. Don't hesitate to contact us if things could be better. Complaints or disputes must be reported within 7 days of delivery. If the complaint is found to be justified, our liability is limited to the exchange of the goods. Any liability of the seller is limited to the actual amount paid for the order.
- Brooklyn handles questions and complaints within a reasonable period of 7 calendar days.
Disputes
- All offers and agreements are exclusively governed by Belgian law, excluding the principles of conflict of laws.
- All disputes related to or arising from offers from Brooklyn, or agreements concluded with it, will be submitted to the competent court in Kortrijk (Belgium), unless a mandatory legal provision explicitly designates another court as competent.
